MYLINK Successfully Represented Archdaily Shanghai in A Trademark Infringement Case

MYLINK has recently represented Archdaily (Shanghai) Information Technology Consulting Co., Ltd. (“Archdaily Shanghai”), which is the subsidiary of ARCHIDAILY, in a trademark infringement dispute with Beijing ZhongHeMeiLian International Business Management Co., Ltd. (“Beijing Zhonghemeilian”),and won the case in its final instance.

The trademark “ARCHDAILY” was registered and owned by ARCHDAILY in Chile in 2009, and has developed into a world renowned brand in the field of architecture media. In 2018, the trademark “archdaily” was squatted by Beijing Zhonghemeilian in China. In 2019, Beijing zhonghemeilian brought a lawsuit again Archdaily Shanghai for the using of “archdaily” in Shanghai Pudong New Area People’s Court. Shanghai Pudong New Area People’s Court, in its first instance court decision, determined that the behaviors of Archdaily Shanghai did not constitute trademark infringement and therefore rejected all claims raised by Beijing Zhonghemeilian. In the second instance, Beijing Zhonghemeilian finally withdrew the appeal. The court decision now has come into force.

Trademark squatting has become one of the biggest obstacles for many international well-known enterprises when they carry out business in China.
